What is a DGSA / Dangerous Goods Safety Advisor?
A Dangerous Goods Safety Advisor (also known as a Dangerous Goods Safety Adviser or an ADR DGSA), is a person certified to provide advice to undertakings whose activities include the consignment, carriage, or the related packing, loading, filling or unloading of dangerous goods. A DGSA would also be expected to monitor compliance with legal requirements and to ensure the preparation of an annual report.
If you are involved in the carriage of dangerous goods by road, rail or inland waterway you must employ the services of either a full time or a part time suitably qualified Dangerous Goods Safety Adviser (DGSA).
What Are the Changes to the Dangerous Good Laws From 31st December 2022?
Prior to 31st December 2022, businesses who transported dangerous goods as a consignor, either on its behalf or for a third party, were under no legal requirement to appoint a DGSA. However, an update to ADR regulations in 2019 stated that those who are consignors/handlers only must also now appoint a Dangerous Goods Safety Advisor, with the appointment being made, no later than 31st December 2022.
This means that as of 31st December 2022, anyone that consigns, transports, picks, packs, organises, fills, loads or unloads dangerous goods on a regular basis, by road, rail or inland waterway, is legally obliged to have a Dangerous Goods Safety Advisor appointed. Some businesses may be given exemption from the requirement, but only if their handling/carriage of dangerous goods is infrequent and in limited quantities.
